These Terms of Use (“Terms”) govern your access to and use of shophelthy.com (the “Site”) and the Helthy mobile application (the “App”), operated by Helthy, Inc. (“Helthy,” “we,” “us,” or “our”). By using the Site or App, you agree to these Terms. If you do not agree, please do not use the Site or App.

Not medical advice. Helthy provides general nutrition and food information to help you shop smarter. It is not a substitute for professional medical advice, diagnosis, or treatment. Always consult your physician or a qualified healthcare provider about your diabetes, medications, and diet, and never disregard professional advice because of something you read or see in Helthy.

Eligibility

You must be at least 13 years old to use the Site or App. By using Helthy, you represent that you meet this requirement and that the information you provide is accurate.

The service

Helthy lets you scan packaged foods for a diabetes-focused read and suggested alternatives, and provides related information through the Site and App. We may update, change, or discontinue features at any time.

Beta program

Parts of Helthy may be offered as a beta or early-access program. Beta features are provided on an “as is” and “as available” basis, may contain errors, and may change or be removed at any time. Feedback you share may be used to improve Helthy.

Acceptable use

Use Helthy only for lawful, personal, non-commercial purposes.
Do not misuse, disrupt, reverse engineer, or attempt to gain unauthorized access to the Site or App.
Do not submit false information or infringe on the rights of others.

Intellectual property

The Site, App, and all related content, branding, and software are owned by Helthy, Inc. or its licensors and are protected by intellectual-property laws. You may not copy, modify, distribute, or create derivative works without our permission.

Third-party links and information

Helthy may reference third-party products, retailers, or nutritional data. We are not responsible for third-party content or the accuracy of third-party information, and referencing a product is not an endorsement.

Disclaimers

The Site and App are provided on an “as is” and “as available” basis, without warranties of any kind, express or implied. We do not warrant that the service will be uninterrupted, error-free, or that any information provided is complete or accurate for your individual circumstances.

Limitation of liability

To the fullest extent permitted by law, Helthy, Inc. and its team will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or App, including any decisions you make based on the information provided.

Governing law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules, and any disputes will be resolved in the courts located there.

Changes to these Terms

We may update these Terms from time to time. When we do, we’ll revise the “Last updated” date above. Your continued use of the Site or App after changes take effect means you accept the updated Terms.
